Terms and Conditions
1. BOOKINGS & PAYMENTS
1.1 All online orders require full payment at the time of booking, unless QUOTE is selected.
1.2 Deposits for quoted bookings are:
- A minimum of $50 or 25% of the order total (whichever is greater)
- Maximum deposit of $250
1.3 Bookings under $50 require full payment at booking.
1.4 Deposits must be paid within 3 working days of invoice issue unless otherwise agreed. Failure to do so may result in cancellation without notice.
1.5 Payment confirms acceptance of these Terms & Conditions.
2. AFTERPAY
2.1 Afterpay is available only at the time of booking.
2.2 Afterpay cannot be applied to quotes, deposits, or remaining balances.
2.3 It is the customer’s responsibility to select a suitable payment method.
3. REMAINING BALANCES
3.1 Remaining balances must be paid no later than 7 days prior to the event date.
3.2 Any final payment made after this date without prior written agreement may result in cancellation at the discretion of Ivy Black Events.
3.3 Any balance outstanding after the event date may incur a 10% late payment penalty every 30 days until paid in full.
4. LATE PAYMENT & DEBT RECOVERY
4.1 Any invoice not paid within 30 days of the due date following the event date, including invoices relating to damaged, lost, or non-returned hire items, will incur late payment penalties and may be referred for debt recovery.
4.2 Ivy Black Events reserves the right to refer overdue or unpaid debts to a third-party debt collection agency.
4.3 The hirer agrees to be liable for all reasonable costs incurred in recovering the debt, including collection agency fees, legal fees, and administrative costs, which may be added to the outstanding balance.
5. BONDS & OUT-OF-TOWN HIRES
5.1 A $100 bond is required for all hires outside the Canterbury region.
5.2 Valid photo identification is required and recorded.
5.3 Out-of-town hire periods may run from Thursday to Tuesday, subject to availability.
6. SELF-COLLECTION & RETURNS
6.1 Collections and returns are available in Kaiapoi on:
- Thursdays, Fridays & Mondays between 5:00pm – 6:00pm
6.2 Collections outside these times are by appointment only.
6.3 Customers must adhere strictly to allocated collection and return times.
6.4 If suitable transportation is not available at collection, Ivy Black Events reserves the right to:
- Cancel the booking, or
- Arrange delivery and charge a $25 late service fee plus delivery costs, subject to availability.
7. DELIVERY
7.1 Delivery is available on bookings over $100 and charged based on location and timing.
7.2 Delivery times are confirmed during the week of the event.
7.3 While preferred times are considered, earlier delivery may be required to accommodate multiple bookings.
7.4 Customers must advise venue access times and event start times at booking.
8. STYLING SERVICES
8.1 Styling and set-up services incur additional charges depending on scope and complexity.
8.2 Styling fees will be confirmed prior to booking confirmation.
9. CANCELLATIONS & POSTPONEMENTS
9.1 Cancellations or postponements more than 60 days prior to the event will receive a credit note valid for 12 months(not redeemable for cash).
9.2 Cancellations or postponements within 60 days of the event forfeit all monies paid.
9.3 Cancellations or postponements within 7 days of the event incur the full hire charge, payable within 30 days.
9.4 Failure to pay may result in referral to a debt collection agency.
10. CHANGES TO BOOKINGS
10.1 Item changes are permitted up to 7 days prior to the event, subject to availability.
10.2 One change per booking is permitted.
10.3 Custom or bespoke set-ups are excluded from changes.
11. LOSS, NON-RETURN & DAMAGE
11.1 All items must be returned on the agreed date and time.
11.2 Any items not returned within 24 hours of the agreed return time will incur an additional hire charge equivalent to one day’s hire, unless otherwise agreed in writing with Ivy Black Events.
11.3 Items not returned after this period may be deemed lost and charged at full replacement cost.
11.4 Replacement cost includes, but is not limited to:
- Current retail replacement value
- Freight, sourcing, and import costs
- GST
- Loss of hire income for confirmed future bookings
11.5 If Ivy Black Events is required to retrieve items, a $150 loss prevention / recovery fee applies.
11.6 Damage beyond fair wear and tear will be charged at full repair or replacement cost, at Ivy Black Events’ discretion.
11.7 Deliberate misuse, negligence, or intentional damage will result in full replacement costs.
11.8 Hire periods are for up to 3 days unless otherwise agreed.
11.9 Only balloons become the property of the client post-event. All other items remain the property of Ivy Black Events.
12. CLEANING FEES
12.1 Items returned excessively dirty (including but not limited to food, drink, wax, mud, glitter, or adhesives) will incur additional cleaning fees.
13. RESPONSIBILITY & USE
13.1 The hirer accepts full responsibility for hired items from collection or delivery until return.
13.2 Items must not be sub-hired, loaned, or transferred without prior written consent.
13.3 All items are for indoor use only, unless written approval for outdoor use is provided.
13.4 Ivy Black Events is not responsible for damage caused by guests, children, venue staff, or third parties.
14. AUTHORITY TO CHARGE
14.1 By accepting these terms, the hirer authorises Ivy Black Events to charge any stored payment method for:
- Replacement or repair costs
- Additional hire charges
- Cleaning, recovery, or loss prevention fees
- Outstanding balances or penalties
15. FAULTS & AVAILABILITY
15.1 All items are tested and photographed prior to hire.
15.2 Any faults must be reported immediately.
15.3 Faults reported after the event date are not eligible for refund.
15.4 If an item becomes unavailable due to damage beyond Ivy Black Events’ control and no suitable substitute is available, liability is limited to a refund of that item only.
16. FORCE MAJEURE
16.1 Ivy Black Events is not liable for failure to perform due to events beyond reasonable control, including but not limited to weather events, natural disasters, illness, government restrictions, or transport failures.
17. LIABILITY LIMITATION
17.1 Ivy Black Events is not liable for indirect or consequential loss, including loss of enjoyment, loss of income, or event disruption.
18. PHOTOGRAPHY & MARKETING
18.1 Ivy Black Events reserves the right to photograph hired items and styling setups for marketing and promotional purposes unless otherwise requested in writing.
19. SPONSORED EVENTS
19.1 Sponsored or donated items may still incur delivery charges.
19.2 Where styling or hire is provided free of charge, the recipient agrees to supply six (6) photographs and a review within 4 weeks post-event.
19.3 Failure to do so will result in a full invoice payable within 30 days.
20. GOVERNING LAW
20.1 These Terms & Conditions are governed by the laws of New Zealand.
